1. Who we are and acceptance
“VMA Platform”, “we”, “us”, and “our” mean the operator identified above. “You” means the salon owner, business, or authorised person using the platform. By creating an account, clicking an acceptance checkbox, placing an order, or using the service, you agree to these terms and the linked Privacy Notice and Refund & Cancellation Policy.
2. Service description
VMA Platform provides hosted salon operations software, including bookings, customer records, invoicing, loyalty, inventory, staff operations, analytics, salon websites, and optional messaging integrations. The platform is a software and workflow tool. It is not a substitute for legal, tax, GST, accounting, employment, medical, or professional advice.
Plans, features, limits, setup work, WhatsApp onboarding, taxes, and third-party usage charges are shown at checkout or in the applicable order confirmation. A feature may require onboarding, accurate business information, a supported domain, or a third-party account.
3. Business responsibility and India compliance
- You are responsible for operating your salon lawfully in each location, including business registrations, municipal or trade licences, fire and safety requirements, labour and contractor obligations, consumer disclosures, and sector-specific permissions.
- You are responsible for correct prices, GST registration and invoicing, tax collection, tax returns, service descriptions, cancellation rules shown to your customers, and any claims made in advertising.
- You must obtain appropriate consent before sending promotional email, SMS, WhatsApp, or other communications. You must respect opt-outs, Do Not Disturb preferences, platform messaging rules, and approved WhatsApp templates.
- You must not upload unlawful, infringing, discriminatory, harmful, deceptive, or personally sensitive content that you are not authorised to process. You are responsible for customer notices and permissions for photographs, reviews, marketing lists, and uploaded documents.
4. Account security and acceptable use
Provide accurate business and contact information, keep credentials confidential, and promptly report suspected unauthorised access. Do not reverse engineer, probe, scrape, overload, resell, impersonate, bypass access controls, use the service for fraud, or use it in violation of Indian law or the law applicable to your business.
5. Orders, Razorpay payments, GST, and activation
Prices are in Indian rupees. The amount shown at checkout is the amount sent to Razorpay, with any applicable tax treatment shown in the order or invoice. Razorpay processes the payment; VMA Platform does not receive or store your full card number, CVV, UPI PIN, or net-banking password. We confirm an order only after server-side verification of the Razorpay signature, order, amount, currency, and captured status.
At present, the public checkout creates a one-time payment order and does not automatically debit a future renewal. If recurring billing, a mandate, or auto-renewal is introduced, it must be separately disclosed with its renewal price, notice, and cancellation method.
Activation may require a verified payment, business information, domain details, and onboarding. Payment confirmation does not guarantee uninterrupted availability or approval of a custom domain, messaging provider, or other third-party service.
6. Customer data, privacy, and security
You remain responsible for the customer and employee data you enter. We process it to provide the service, support security, send requested transactional messages, process payments, comply with law, and improve reliability. The Privacy Notice explains data categories, processors, retention, rights, and contact details. Use role-based access, strong passwords, and the minimum information needed for salon operations.
7. Intellectual property and user content
We retain rights in the VMA Platform software, branding, documentation, and platform design. You retain rights in your salon data, branding, photographs, copy, and other content you provide, subject to the permissions needed for us to host, back up, display, and transmit it to deliver the service. You confirm that your content does not infringe another person’s rights.
8. Availability, third parties, and support
We aim to operate a reliable service but do not promise uninterrupted availability unless a separate written service level applies. Internet providers, Razorpay, email, SMS, WhatsApp, hosting, domain registrars, and other providers may have outages, rate limits, or rules outside our control. We will use reasonable efforts to investigate reported issues.
9. Suspension and termination
We may restrict or suspend access where reasonably necessary for security, non-payment, unlawful activity, misuse, a third-party provider requirement, or a material breach. Where practical, we will provide notice and an opportunity to correct the issue. You may stop using the service and request cancellation under the Refund & Cancellation Policy. Data export or deletion timing should be confirmed with support before an account is closed.
10. Liability and mandatory rights
To the maximum extent permitted by applicable law, the platform is provided without guarantees that it will meet every business requirement. Neither party is responsible for indirect or consequential loss to the extent the law permits that exclusion. Any liability cap must be finalised by the operator’s lawyer for the actual entity, plan, and customer type. Nothing in these terms limits a right or remedy that cannot lawfully be limited, including mandatory consumer protections.
11. Complaints, governing law, and changes
Send legal, payment, privacy, or service complaints to info.vmaplatform@gmail.com with your salon name, account email, order/payment ID, and a clear description. We will acknowledge the request and try to resolve it within a reasonable time.
This Agreement, and any dispute, controversy, proceedings, or claim of whatever nature arising out of or in any way relating to it or its formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of India. Each party irrevocably agrees that the courts of Gurugram, Haryana shall have exclusive jurisdiction to hear, settle, and determine any dispute, action, suit, or proceeding arising out of or in connection with this Agreement or the services provided by VMA Platform. The parties explicitly waive any objection to such courts on the grounds of an inconvenient forum.
We may update these terms for a new feature, legal requirement, security reason, or service change. Material changes should be shown before the next purchase or renewal. The policy version shown above identifies the wording accepted at checkout.
